Hypo Friday: Larry Landlord and The Late Fee Flop

Tina Tenant has been delinquent in her rent payments for the past two months. Per her agreement with Larry Landlord, she is also required to pay a 10% late fee each time her rent is late.

Q: Can Larry add these additional charges to his 3-Day Notice to Pay Rent or quit?


A: No.  This is an unfortunate mistake that is often made by landlords resulting in issues at the time of trial or even worse, a judgment against them.  The 3-Day Notice to Pay Rent or Quit is for the payment of rent only.  Larry can only include what Tina owes in rent per month.  Any additional charges can potentially lead to a notice being deemed defective and a big loss for Larry.
